Event Terms & Conditions

Kaleidoscope Learning (87-1350772)

 

These events are owned and operated by Kaleidoscope Learning and its affiliate organizations, such as, but not limited to, Monarch Montessori School.  These Terms set forth the terms and conditions under which you may attend our events and use services as offered by us.  These events offer visitors family community-building opportunities and parent education nights.  By clicking the check-box stating that you have read these terms and conditions, or attending these events, you approve that you have read, understood, and agree to be bound by these Terms.

 

Registration and Attendance

Any attendee over the age of 18 may register to attend a Kaleidoscope Learning hosted event.  Registration for an event can be completed on the Kaleidoscope Learning website "www.kscopelearning.org" or Kaleidoscope Learning associated event websites such as, but not limited to, Eventbrite "www.eventbrite.com". 

 

All attendees must register, reserve, or RSVP for a Kaleidoscope Learning hosted event unless otherwise indicated.  From time to time, Kaleidoscope Learning may host an event that may not require registration, reservation, or an RSVP.  These events include, but are not limited to, open houses, Open Play Hours, meet and greet events, or events hosted by affiliate organizations.

 

Attendees must indicate the number of adult(s) and child(ren) attending the event when registering, reserving, or RSVPing to any Kaleidoscope Learning event.  All Kaleidoscope Learning event registration forms will have designated questions where attendees can indicate the number of adult(s) and child(ren) attending the event.  All child(ren) attending a Kaleidoscope Learning event must be supervised at all times by an adult, such as, but not limited to, a parent.

 

If an attendee has any changes to the status of their registration, including cancellation, they are required to notify the Kaleidoscope Learning team of such changes by email, text message, phone call, or verbal conversation.

 

Kaleidoscope Learning and its affiliate organizations, such as, but not limited to, Monarch Montessori School, reserve the right to remove any attendee from an in-progress event for any reason.  Such reasons can include, but are not limited to, inappropriate behavior or violation of Kaleidoscope Learning policies, such as the Event Terms & Conditions by an attendee.

 

Cancellation

This Agreement shall continue in full force and effect until the first to occur of:

  • The attendee wishes to cancel their reservation or RSVP to a Kaleidoscope Learning event.

  • A Kaleidoscope Learning staff member has terminated an attendee's reservation, registration, or RSVP for reasons such as, but not limited to, violating any of Kaleidoscope Learning's policies or terms & conditions, such as, but not limited to, the Event Terms & Conditions.

Attendees who wish to cancel their registration, reservation, or RSVP must inform the Kaleidoscope Learning team of their cancellation.  Attendees can inform the Kaleidoscope Learning team of their cancellation either verbally via in-person or phone call, or by emailing or texting their cancellation.  Attendees are advised, but are not required, to give a reason for their cancellation. 

 

If an attendee wishes to cancel their registration, reservation, or RSVP to a Kaleidoscope Learning event, they will also cancel the registration, reservation, or RSVP of any other attendees that were included on their reservation.  This includes, but is not limited to, child(ren) and other adult(s) attending with the RSVPing attendee.

 

Kaleidoscope Learning reserves the right to cancel an event at any time. When a Kaleidoscope Learning staff member cancels an event, the event attendees will be notified via email the cancellation of the event.  Attendees who wish to learn more about the canceled event should reach out to the Kaleidoscope Learning team via email. 

The following sections are not relevant to cancellation: Copyright, Trademarks, Limits of Responsibility, Disclaimer of Liability, Arbitration, Indemnification, Conflicts.

 

Copyright

All content used for our events, and the compilation of it, including text, visuals, logos, and audio and video clips is the property of Kaleidoscope Learning and kscopelearning.org or its collaborators, such as content creators, partner organizations, including Monarch Montessori School, and toy makers, among others.  You are strictly prohibited from claiming our content as your own.

 

Trademarks

All trademarks, logos, service marks and trade names belong to Kaleidoscope Learning, or others who may be contributing to the Educational Materials Library such as, but not limited to, Monarch Montessori School.

 

Limits of Responsibility

Kaleidoscope Learning and its affiliate organizations such as, but not limited to, Monarch Montessori School is not responsible for any injury, damage, or loss of the attendee, covered child(ren), or any other user(s) during operation of material(s) made available during event(s) hosted by Kaleidoscope Learning or its affiliate organizations.

 

Disclaimer of Liability

Kaleidoscope Learning, and its affiliate organizations such as, but not limited to, Monarch Montessori School, assumes no responsibility for the misuse of materials, furniture, and other products used during events. In no event is Kaleidoscope Learning and its affiliate organizations, such as, but not limited to, Monarch Montessori School, liable for any indirect, special, punitive, incidental, exemplary or consequential damages, even if Kaleidoscope Learning or Monarch Montessori School has been previously advised of the possibility of such damage in connection with the use, performance or performance failure of the content, services, materials, and toys used during their events and Family Symposiums.

While every effort has been made to ensure the accuracy of the information in our event materials, such as, but not limited to, brochures, slideshows, videos, and flyers, Kaleidoscope Learning is not responsible for any errors or omissions.  This information should not be taken to constitute legal advice or opinion, or to replace industry professional guidance.  Kaleidoscope Learning and its affiliate organizations such as, but not limited to, Monarch Montessori School, disclaims all responsibility and accepts no liability (including negligence) for consequences of any person acting, or refraining from acting, on this information. 

Attendees and members acknowledge that goods used during Kaleidoscope Learning events may be dangerous if improperly used.  Attendees and members must contact the original manufacturer of item(s) used to obtain up-to-date safety precautions, operation manuals and other information to ensure the safe operation of materials and the safety of those, including child(ren), who are using them.  Kaleidoscope Learning and its affiliate organizations such as, but not limited to, Monarch Montessori School, are not responsible for any loss or injury resulting from defects or alleged defects in items used during their events and Family Symposiums, or from their use.

 

Indemnification

You agree to indemnify and hold Kaleidoscope Learning and Monarch Montessori School harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your attendance of an in-person or online event, use of this website, or any of the services offered by Kaleidoscope Learning or Monarch Montessori School. 

 

Arbitration

Any dispute, controversy or claim between the parties arising out of or relating to this Event Terms & Conditions or the breach, termination or validity hereof shall be referred to and finally resolved by binding arbitration in Saint Paul, Minnesota, to the exclusion of all other procedures, in accordance with the rules then in force of the American Arbitration Association, which are deemed to be incorporated by reference into this Section 9.  In any such arbitration, one arbitrator shall be appointed in accordance with such rules.  Where the rules of the American Arbitration Association do not provide for a particular situation, the arbitrator shall determine the course of action to be followed.  To the maximum extent permitted by applicable law, the parties agree not to assert any rights to have any court rule on a question of law affecting the arbitration or to hear any appeal from or entertain any judicial review of the arbitral award.

 

Conflicts

In the event of a conflict between the terms of this Agreement and the terms of Kaleidoscope Learning’s Event Terms and Conditions, the terms of this Agreement shall prevail.  In the event of a conflict between the terms of this Agreement and the terms of any Future Agreement, the terms of the Future Agreement shall prevail.

 

Governing Law

The Laws of the State of Minnesota will govern these Event Terms & Conditions.
